A code of law.

As my next half of the book will soon involve a court case I though it best to have some idea of what that would be like. So I started drafting a bit of a guide book. Here is a bit from it, as silly and as unedited as it is. Mid you it is not meant to be a reasonable one. Well you will see. It is silly and over the top. 




In all crimes the mental states must be taken into account and if the person is found to be unsound they will be committed to a government run facility until such time as they no longer pose a threat. Should that be do only to medication and the illness and it likely that the person will stop the medication they will be moved to a supervised housing facility that will let them have as normal a life as they can while being monitored.

Murder

Murder clearly is the worst crime and will get the highest Apunishment that is death of the perpetrator. However even with it not all are the same. There are those that plan and those that acted rashly and such should not be treated the same. Anyone who has deliberately killed more than five people is not going to change; unless there is a clear mental issue that can be treated the only punishment is death. This includes mass killings, though we pray that those events are things of the old world. Nothing can be taken for granted. They will have one month to file an appeal before the sentence is carried out. Once the first papers are filed the sentience is suspend until the apple has be heard and determined. It is not done lightly, but there is no point in giving them years to wait. A planed killing likewise is worthy of a death sentence, for it is clear they intended to take a life and so forfeited theirs. Yet there are times when it isn’t so simple. The circumstances must be considered. Therefore the maxim is death, but there is the option of prison sentence of forty years or more. Then there are those killings that happen in the heat of the moment, by accident, with no intent and no planning. Death is off the table for this. It would be an overreaction. There is so much to consider here that it needs a wide rand. Max is 80 years, so normally a life sentence, min is ten.

Accidently Homicides must still be punished, for all the guilt is going to weigh more than the sentence. Min is 1 year jail and 4 years parole Max is 10 years and 4 parole.

Killing in defense of self or of others has no penalty. All have the right to defend their selves and such needs not go to court unless the investigators are unsure that there was a real danger or that the person truly felt their life was in imminent danger. Protecting the safety of a child is also forgivable but is more likely to require a trail to determine if that was indeed the cause of the action, and not simply anger.

Abuse and corruption of minors.

Childhood is the most important time in anyone life and should be protected. Yet there are those that seek to pry on child, seek to use there innocence and pervert it. There are those that would teach them to welcome sin. Those that would hurt them. This is tragic and must be dealt with harshly. There are times here when it is only right to invoke the maximum punishment. Those that would harm a child are the lowest. They are right there with the murders and so will be treated as such. Any that have done lasting harm to a child or forced them to engage in adult actives are fit for the death penalty. We will allow that there might be times that a lesser plenty is needed to that end the minimum will be 50 years, but it is found distasteful.

Any injury is of course distasteful and despicable but a line had to made. We would love to make it the same no matter what, but that would be an over reach. As much as we wish it wasn’t so it was found that there should be a lighter sentence available for those that do not do permanent harm. This is also fitting for neglect and for corporation. That is teaching illegal beliefs, providing intoxicating substances, and encouraging illegal behaviors. So 60 is max, that is better than they deserve, 40 is minimum.

In the case of a supposed parent harming a child that parent loses custody off all children they have at the time and any they have after. If there is a relative will to take them in that is perfect placement, if not then a second family must be found. Siblings are to be kept together, though new children need not placed with older ones.

Not that spanking is not abuse. Physically abuses means broken bones and or purple bruises. Verbal abuse is leading the child to feel they are worthless, making it scared to talk or try and yes that is equal to physical abuse but it is going to be far hard to find and prove, but try. All have a right to dream, to achieve. To be the best they can. None should be prevented from archiving their best.

Theft

The taking of another person’s property is another of those crimes that all can agree is wrong, so no surprise that it is considered a major crime. The severity will determine where in the range the sentence will fall. Max of 60 years Min of 5. Probation added at judge’s discretion. Restitution will be paid.

Copyright infringements are a form of theft but far harder to track and prove then other thefts. We hope that by insisting that artist have sites that will let them be paid directly in addition to the new tighter regulations and the banning of the massive downloading sites this type of theft will be vastly diminished. Still it will be there. There are some that will find a way, no matter how we try. Here we are looking at max of 3 years in prison followed by four of probation, min of 8 years probation with community service. Both will include full restitution and an extra 100 dollars for the affected individuals.

Up loaders must pay and added fine to the courts of no more than one thousand per item and no less than five hundred per item. May this be an added deterrent.

 In addition all cyber crimes include three years in which it is illegally for the person to have any device that will let the connect to the internet, and they will be on probation that induces the right of offices to search their residences. It is harsh but criminals give up all rights to privacy for the length of their instance.

Magic use, Witchcraft and related actions

It is not as clear cut as it should be, some pretend some act without the energy and call it magic, others use illegal religion. This is touchy and troubling. The Word is clear when it says suffer not the witch to live. Yet killing those who chose to take up that evil just brought use new problems and was too harsh. It just wasn’t the right answer, not for the world we live in.

Then to there were questions of how to define who was a witch in this world. It is not so cut and dry when you have a religion that refers to its members with such a distasteful distinction and magic uses who insist they are not witches. Some even say they are follows of the Lord, yet how that could be when clearly they have turned their backs. That is a matter for religious laws not the criminal code that I am meant to be recording here. It is just hard for this one, and it was the longest debate.

The first years are full of stories of all the persons in this set being killed. Some in very inhumane ways. It was brutal and if anything it taught us what not to do. One thing those reports did was show the need for firm laws. Still it was a hard task to decide what to do, how much belonged in the religious courts and how much in the crime courts?

Clearly it was a crime and needed to be dealt with. However death was far too harsh. It is serious, but it doesn’t warrant that penalty. Not only is it to server for the crime we also need to be aware of how it makes us look. We can’t be killing those who disagree with us out of hand, we are not strong enough to do that and keep our nation. There must be balance and limits, or we will be seen as evil and needing to be toppled before we become a threat to our neighbors. Yet the word was clear. So how could it be handled, yet have the punishment fit the crime and the teaches? To that end they called on the priests to help them find an answer. None are fully happy, and wish there was another way. A way to see none fall to the evil. However it is clear some will and so here is the answer they found. It is harsh, but yet not as bad.

The persons that use the energy, those that cause real changes in the world around them were determine to be the worst of the group. So they will receive the harshest penitently. There is no hope of recovery or repentance. They will not be killed but will be exiled, with a permanent ban. They may never return to visit any here. Contact may happen as with any from outside, over the governed channels online. It isn’t safe to have any unfiltered contact with these persons, in fact the more contact with them is limited the better for all, but we will not insist that they be cut out. For that would be unfair to those that cared for the deviant. They will not be sent out empty handed, for all some think they should be. In addition to seeing that their savings and personal items go with them the government will set them up in an apartment, with three months’ rent paid. They will be relocated to Canada or Mexico, their choosing, and the government there will assist them once they are there. Should they not choose then we will pick the one that has seen the least immigrant for it will be easier on them.

That is for those not guilty of any other crime. for those that are there will be no additional funds, as those will be used to see to their housing in the correctional institution, in accordance with the laws of the neighbor who is housing them. It will depend on the crime which will take them. Likewise communication with them will be dependent on those laws. The family will be given all instructions at that time.

For those practice a different region, that will be referred to the church, but they too will be offered a relocation package covering four months, with no ban on visiting or restrictions on communication that beyond what is placed on any who live outside of our lands.

As for those that would pretend to do magic for the sake of causing trouble. That is a crime worthy of jail time. As they seek to cause harm it was decided that minim will be 3 years and a max of 5, with that to double for each arrest. It will do nothing to undo the harm, but it might give them a reason to reconsider doing it. There will likely be further actions from the Church court as well, for it is pandering to other religions and affecting their beliefs.

It is a sad thing to lose a child, but maybe this is better than death. It seems more humane, but still it would be best if it wasn’t necessary to exile any. to that end the four month package is to be available to all and information on it is to giving multiple times to all children entering their last years of High school though the first years of Collage or work, and will be freely available at all government and city offices.

Relations outside of marriage

This will be left to the church court to deal with, but will have the full immigration sunspot package available. However there will be nothing barring them from visiting, and nothing recorded in the government records save that they are immigrant and so can have a visa without restrictions or a guide needed.

Non prescription use and traffic of Drugs.

This is not as big of a problem these days, and we hope it stays that way. Incarcerating alone did no good. It is hard to fight be we are hoping that parried with mandatory treatment it will help. There will be a treatment program for the full length of the sentence not just for the time for the drugs. The minim will be a two year incarnation followed by five years in a treatment program that includes random tests. Should they fail a test they will go into an in a residential treatment program for the remainder of the time or until the supervise feel they are ready to leave, whichever is first. Max is 5 years incarnation, with the same follow up treatment. The sentence doubles with each arrest, even should that arrest happen during the treatment time.
